Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and the operator of starterpg.com (“starterpg”, “we”, “us”). They apply to every use of the website, dashboard, APIs, databases, storage, realtime gateway, and related software (the “Service”).

By creating an account, clicking to accept, or using the Service, you agree to these Terms and to the Privacy Policy. If you do not agree, do not use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind it, and “you” includes that organization.

1. The Service, as it actually is

starterpg provides managed PostgreSQL and related features (REST, auth, files, realtime, webhooks). Paid and free projects live as databases and roles on a shared Postgres instance. We do not provide a dedicated virtual machine, a dedicated database instance, or an uptime SLA unless we sign a separate written agreement that says so.

The Service is an early product. Features may change, break, or be removed. Capacity is finite. We may refuse, throttle, pause, migrate, or delete workloads that threaten the shared instance or other customers.

Third parties we rely on include Stripe, our auth provider, and our hosting providers. Their failures, rate limits, and policy changes are not a breach of these Terms by us.

2. Eligibility and accounts

You must be at least 18 years old. You are responsible for everyone who uses your account, API keys, database passwords, and JWT secrets. You will keep credentials secret. A leaked publishable or secret key is your problem; rotate it. We may assume that activity under your credentials is yours.

3. Your content and your users

You retain ownership of data you store in the Service (“Customer Content”). You grant us a worldwide, non-exclusive license to host, copy, transmit, back up, and otherwise process Customer Content solely to operate, secure, troubleshoot, and improve the Service, to comply with law, and to enforce these Terms.

You represent that you have all rights needed to store Customer Content and that it does not violate law or third-party rights. You are the controller of personal data you put in your databases and of your application’s end users. We process that data as a service provider / processor only to provide the Service.

Platform operators can technically access customer databases (provisioning uses a superuser). We do not inspect Customer Content except as needed to run the Service, investigate abuse, or comply with law. Do not put data in the Service that you cannot accept being processed on shared infrastructure.

4. Acceptable use

You will not, and will not allow others to:

• break the law, or store or transmit illegal content;
• probe, scan, or attack the Service, other tenants, or third parties;
• mine cryptocurrency, send spam, operate botnets, or run open proxies;
• overload the shared instance (connection storms, unbounded jobs, or storage bombs) after we have asked you to stop;
• store cardholder data in scope of PCI-DSS, protected health information under HIPAA, or other regulated data that requires a BAA or similar contract we have not signed;
• resell the Service as a competing hosted database platform without our written consent;
• circumvent plan limits, billing, or authentication.

We may suspend or terminate immediately for suspected abuse, without prior notice, and we have no duty to host content we believe is unlawful or harmful.

5. Backups, durability, and data loss

You are solely responsible for exporting and backing up Customer Content. The dashboard may keep recent per-project snapshots you can download or restore. That is a convenience, not a restore SLA and not point-in-time recovery. Use pg_dump or any Postgres client as well. Instance-level copies, if enabled, exist for our disaster recovery of the shared machine. We do not promise we can restore your database, to a point in time or at all.

Free projects may be paused after 7 days idle and deleted after 60 days idle, after we attempt to email the account. Paid projects are not auto-deleted for idle, but non-payment, abuse, or termination still ends access. Deleted data may be unrecoverable. Provisioned disk does not shrink; that is a platform cost issue, not a warranty to you.

6. Plans, fees, and no refunds

Plan limits in the product are the contract. Current list prices: Free $0; Pro $10/month; Pro+ $29/month; Ultra $399/month; Scale $799/month, with the allowances shown at signup and on the pricing page. Each plan has an enforced cap. More databases, storage, files, egress, or hosted embed tokens require the next plan. Past Scale, contact us.

Payment is processed by Stripe. You authorize recurring charges until you cancel. Taxes may be added. Fees are non-refundable except where law requires a refund. Downgrading or unused capacity is not a refund. If a charge fails we may suspend paid features. Unused capacity is not a refund. Past Scale, contact us.

7. No warranty

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT DATA WILL NOT BE LOST. THERE IS NO SERVICE LEVEL AGREEMENT.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, REVENUE, GOODWILL, OR BUSINESS, EVEN IF ADVISED OF THE POSSIBILITY.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE THREE MONTHS BEFORE THE CLAIM OR (B) FIFTY U.S. DOLLARS ($50). IF YOU ARE ON THE FREE PLAN AND HAVE PAID NOTHING, OUR TOTAL LIABILITY IS $50. THESE LIMITS ARE A FUNDAMENTAL BASIS OF THE BARGAIN. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE PLACES OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED.

9. Indemnity

You will defend, indemnify, and hold harmless starterpg and its operators, officers, and contractors from any claim, damage, cost, and reasonable attorney’s fees arising from: Customer Content; your application and end users; your use of the Service; your violation of these Terms or law; or your infringement of anyone’s rights. We may assume control of the defense at your expense.

10. Suspension and termination

You may stop using the Service at any time and export your data first. We may suspend or terminate the Service or your account at any time, with or without cause, including for non-payment, abuse, legal risk, or discontinuation of the product. After termination we may delete Customer Content. Sections that by nature should survive (including 3–9, 11–13) survive.

11. Disputes

These Terms are governed by the laws of the State of California, USA, excluding conflict-of-law rules, except where a mandatory consumer law in your country says otherwise.

Except for claims that may be brought in small-claims court, you and we agree to resolve disputes by binding individual arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. YOU WAIVE ANY RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate claims. If this waiver is found unenforceable as to a particular claim, that claim must proceed in court and the rest remains in arbitration.

You must send a written notice of dispute to support@starterpg.com and wait 30 days before starting arbitration, so we can try to resolve it.

12. Changes

We may change these Terms by posting an updated version. The “Last updated” date will change. Continued use after the update is acceptance. If you do not agree, stop using the Service and export your data.

13. Everything else

These Terms and the Privacy Policy are the entire agreement. If a provision is unenforceable, the rest remains. We may assign these Terms in connection with a merger, sale, or reorganization. You may not assign without our consent. Failure to enforce is not a waiver. The Service is not offered to persons prohibited by export or sanctions laws.
